RCW 46.68.200 restricts to the Legislature the authority to designate additional Washington ports of entry for highway transportation of radioactive waste material. RCW 46.48.200 expires when both the Washington Legislature and at least one other eligible state enact an interstate agreement on radioactive materials transportation management. The enactment of the Pacific States Agreement on radioactive Material Transportation Management, codified in RCW 43.146.010, did not cause RCW 46.48.200 to expire.
1. A properly tagged off-road vehicle (ORV) is not permitted to be operated along a public highway. 2. A county, city, or public subdivision of the state lacks authority to permit off-road vehicles (ORVs) to be operated within its boundaries, except on roads which meet the statutory definition of “nonhighway roads” in RCW 46.09.020(7).
A public transportation benefit area organized pursuant to chapter 36.57A RCW has the authority to construct, on its own or in connection with other governmental agencies, a roadway for use exclusively by transit vehicles, transit access ramps associated with a new or existing roadway; or, with qualifications, a central passenger facility for use by various modes of travel; such an agency does not, however, have the authority to construct a roadway for general use by private automobiles.
