On January 17, 2024, the Wing Luke Civil Rights Division of the Washington Attorney General’s Office (AGO) entered into a Consent Decree with AGA Service Company and Jefferson Insurance Company (together, “Allianz”), in the case of State of Washington v. AGA Service Company and Jefferson Insurance Company, King County Superior Court No. 21-2-05989-5 SEA. The parties filed the Consent Decree with the Court and it has been approved. As part of the Consent Decree, Allianz has paid $1.5 million to fully compensate customers impacted by Allianz’s unlawful discrimination and unfair and deceptive business practices. These funds will be distributed at the AGO’s direction to Allianz customers whose claims for travel losses due to a “covered illness” or “medical condition” were denied based on a discriminatory “Mental and Nervous Health Disorder” exclusion contained in its policies. The amount that each individual receives will depend on the amount of the original travel loss claim and the premiums paid—plus interest.
