PRINTING FOR STATE APPLE ADVERTISING COMMISSION AND STATE FRUIT COMMISSION

The State Apple Advertising Commission and the State Fruit Commission are state agencies which must obtain their printing from the state printing plant.

Dear Sir:

            Receipt is hereby acknowledged of your letter of August 21, 1952, in which you request our opinion as to whether the State Apple Advertising Commission and the State Fruit Commission are state agencies within the meaning of statutes requiring state printing to be handled through the state printing plant.

            It is our conclusion that both the State Apple Advertising Commission and the State Fruit Commission are state agencies and their printing is required to be handled by the state printing plant.

                                                                     ANALYSIS

            Washington State Apple Advertising Commission is set up by chapter 15.24 RCW (chapter 195, Laws of 1947; RRS § 2874-2 et seq.), and the State Fruit Commission is set up under chapter 15.28 RCW (chapter 73, Laws of 1947; RRS § 2909-10 et seq.).  The latter is frequently referred to as the Soft Fruit Commission since it is concerned primarily with the handling of soft fruits.  Both of these agencies are established by statutory authority and are vested with powers to levy compulsory assessments.  Each has legal status to carry out a state policy.  They are in all respects state agencies.  RCW 43.78.030 (RRS § 10325; § 3, chapter 168, Laws of 1905 as last amended by § 1, chapter 129, Laws of 1917) relative to the public printer provides:

            "The public printer shall print and bind * * * such forms, blanks, record books, and printing and binding of every description as may be ordered by all state officers, boards, commissions, and institutions, and the supreme court and officers thereof as the same may be ordered on requisition, from time to time, by the proper authorities: * * *"

            Both of the agencies above mentioned are state commissions and are definitely agencies of the State of Washington and, in our opinion, must obtain their printing from the state printing plant.
