Dear Senator Talley:
This is written in response to your recent letter requesting our opinion on the following question:
"Would a man who operates a charter boat which comes under Coast Guard regulations and clearance, be barred from serving as a member of the Governor's Advisory to the Fishing Commission?"
ANALYSIS
We believe that the proper designation of the advisory body to which your question refers is "Governor's Fisheries Advisory Committee." This committee is not a statutory body. Instead, we are advised by the governor's office that it is a committee which was established, informally, by Governor Rosellini some years ago and which has been continued in operation by Governor Evans on the same informal basis.
Thus, there are simply no laws governing the composition of this committee, and therefore no laws which would preclude a person who is the owner of a charter boat subject to coast guard regulations from serving as a member thereof.
