An organization that sponsors a team of its members to act as covered
volunteer emergency workers is immune from liability under RCW
38.52.180(3)(d) or (f) only if the organization is the employer of the
covered volunteer emergency workers or is a local organization (created
by a county, city, or town) that registered the covered volunteer
emergency workers.
If the state of Washington were to assume responsibility, by law, for inspecting and approving the operation of nonfederal dams, it would then follow that the State could, in a given case, be held liable ". . . for the failure of the dam which had been inspected and approved."
The provisions of RCW 81.48.010, requiring trains to ring their bells or sound their whistles prior to crossing a traveled road or street, are not applicable where only a private road is involved.
(1) Motor vehicles otherwise lawfully participating in a funeral procession, whether or not accompanied by escort vehicles, are required to obey the instructions of any official traffic control device applicable thereto unless the particular funeral procession is escorted or controlled by a traffic or police officer who otherwise directs. (2) A county or city ordinance purporting to provide an exemption for funeral processions not provided for by the state motor vehicle code would be invalid.
(1) An officer or employee of the state would be liable for the consequences of his own wrongful or negligent acts in the operation of a state‑owned car.(2) A state parole or probation officer has the duty safely to transport a parolee or probationer in a state owned car, and would be liable for injuries due to his actionable negligence.
