JURISDICTION OF BOUNDARY REVIEW BOARD OVER INTERCOUNTY MUNICIPAL ANNEXATION ‑- APPLICABILITY OF STATE ENVIRONMENTAL POLICY ACT (1) A county boundary review board has jurisdiction over a proposal to consolidate a city located within the county with other cities in an adjacent county; however, the only issue which should be deemed to be before the board is whether that city should be included in the proposed new municipality. (2) The provisions of chapter 43.21C RCW, the State Environmental Policy Act (SEPA), are applicable to any review undertaken of such a consolidation proposal by the boundary review board.

COUNTIES ‑- CONSOLIDATION ‑- LEGISLATION WITH VOTER APPROVAL The legislature may without violating the state constitution enact legislation providing for the consolidation of Benton and Franklin counties with the approval of a majority of the voters of each county.

SCHOOL DISTRICTS ‑- CONSOLIDATION ‑- ELECTION To validate a proposed consolidation of whole existing school districts with part of an existing district, an election is required to obtain majority vote of the electors of each whole district separately and a majority vote of the electors of the part district residing within the proposed new district.

SCHOOL DISTRICTS ‑- CONSOLIDATION ‑- TRANSFER OF TITLE TO SCHOOL PROPERTY Upon consolidation of one school district with another title to the school property of the old district vests automatically in the new district without the necessity of execution of a deed by the old district to the new.
