NOTE:  The Attorney General’s Office’s policy is not to comment on ongoing, non-public investigations, including confirming whether a particular matter is under investigation.  Because WAFLA challenged our CID in a public court filing, the AGO can confirm it is investigating the group for possible antitrust violations relating to wages for temporary agricultural workers under the H-2A program.

“My office is conducting an investigation into serious allegations against WAFLA.  Rather than cooperate with our subpoena, WAFLA chose to impede our investigation and challenge the basis of our demand for information in court.

“The authority of the Attorney General’s Office to issue Civil Investigative Demands is well established and rarely contested. In fact, my legal team is unaware of a successful challenge to this authority.

“I am confident the court will affirm our authority to issue this CID and compel WAFLA to respond to it.”
